1. Company Identification

2. Legal Framework

These Terms and Conditions are strictly governed by current Portuguese legislation, namely:

• Decree-Law no. 47/2018: Establishes the legal framework for access to and exercise of the activity of hiring motor vehicles without a driver (rent-a-car).

• Decree-Law no. 24/2014: Regulates distance contracts and contracts concluded away from business premises (e-commerce and online bookings).

• Law no. 24/96 (Consumer Protection Act): Establishes the legal framework applicable to the protection of consumers.

• Portuguese Civil Code: Regulates contractual obligations and public liability for damage.

3. Hire Requirements

• Minimum Age: The driver must be at least 18 years old.

• Driving Licence: Presentation of a valid driving licence (Category B) is mandatory.

4. Use of the Buggy

• Conditions of Use: The vehicle must only be driven by the persons authorised in the contract.

• Restrictions: Driving under the influence of alcohol or narcotics, subleasing the vehicle, or participating in races is strictly prohibited.

• Highway Code: The customer is solely responsible for complying with the Highway Code (Código da Estrada) and for paying any fines/penalties received during the hire period.

5. Prices and Deposit Policy

• Price: The hire price includes the vehicle, mandatory insurance, and VAT at the legal rate in force.

• Deposit Policy: As a rule, bookings do not require a security deposit. However, a deposit (with no fixed amount defined) may be required depending on the chosen tours and at the sole discretion of the company.

• Liability: If applied, information regarding the deposit will be provided before the start of the tour. The absence or waiver of a security deposit does not dismiss the customer's public liability for damage caused to the vehicle by gross negligence.

6. Insurance and Liability

• Insurance Included: The hire includes Mandatory Public Liability Insurance.

• Road Accidents: In the event of a road accident, the driver of the buggy will be liable for damage caused to the hired vehicle itself, in accordance with the decisions and fault assignments made by the insurance companies involved in the claim.

• Total Exclusions: Under no circumstances does the insurance cover damage caused by gross negligence, driving off authorised tracks/roads, loss of keys, or intentional damage, with the customer being fully responsible for all costs in these scenarios.

7. Cancellations and Refunds

• Free Cancellation: Up to 72 hours before the start of the hire, with a full refund.

• Late Cancellation: After this period, a fee of 100% of the total booking value will be charged.

8. Privacy and Data Protection Policy (GDPR)
In compliance with Regulation (EU) 2016/679 (GDPR) and Law no. 58/2019 (Data Protection Act in Portugal):

• Data Controller: Impulso100mapa Lda.

• Purpose of Data: The data collected (Name, NIF, Driving Licence, Contacts, Payment Data) is used exclusively for entering into and executing the hire agreement, invoicing, and complying with legal obligations (such as reporting to police authorities, if required by law).

• Retention Period: Data will be kept only for the period strictly necessary to comply with the fiscal and legal obligations in force in Portugal (generally 10 years for billing data).

• Consumer Rights: You have the right to access, rectify, restrict, or erase your personal data, simply by sending a request to the email: impulso100mapa@gmail.com

• Supervisory Authority: If you consider that your data is not being processed lawfully, you may lodge a complaint with the National Data Protection Commission (CNPD).

9. Cookie Policy
In compliance with Law no. 41/2004 (E-Privacy Act):

• Strictly Necessary Cookies: Essential for the functioning of the website and for processing online bookings.

• Performance/Analytical Cookies: Allow us to analyse website traffic anonymously to improve our service.

• Consent: By browsing the website, you can accept, reject, or customise your cookie preferences through the initial configuration panel (Cookie Banner).

10. Complaints and Disputes

• Complaints Book: In compliance with Decree-Law no. 156/2005, our company provides direct access to the Electronic Complaints Book (Livro de Reclamações Eletrónico) through the official link in the footer of our website or directly at www.livroreclamacoes.pt.

• Dispute Resolution: In compliance with Law no. 144/2015, information regarding Alternative Dispute Resolution (ADR) entities is available under a tab dedicated exclusively to this purpose in the main menu/footer of our website.

11. Governing Law and Jurisdiction
This contract is governed by Portuguese law. For the resolution of any dispute arising from this contract that cannot be resolved by mutual agreement or via consumer arbitration, the Court of the Judicial District of Penafiel (Tribunal da Comarca de Penafiel) is stipulated as strictly competent.
